CHILD CUSTODY

Legal Custody, Physical Custody & Paternity Status

We know your children are important to you, so they’re important to us. At Kleinman Law, we will file for child custody immediately in order to have your case listed. We will then work closely with you to understand your needs and design the custody arrangement that suits you and your family best. There are two types of custody: legal custody and physical custody. Legal custody gives a parent the right to make long-term decisions about how his/her child is raised, along with the right to oversee key aspects of that child's welfare (medical care, schooling, religion, etc). Physical custody determines which parent the child spends time with, as well as which parent has the right to make everyday decisions.

 

We will do our best to ensure that you end up with the custody arrangement that works best for you and your family. This means taking clients who wish to, or already have, primary custody, shared custody, partial custody, and visitation.

In some cases, it may be important to establish paternity status--which can be determined via blood testing or other methods. Where relevant, we can assist you with this service.

LGBT LAW

Same-Sex Divorce, Adoption & Transgender Advocacy

The law as it relates to LGBT issues is ever-evolving.  Same-sex marriage became legal everywhere in 2015 following a Supreme Court ruling. And, while more and more couples have entered into same-sex marriages since this ruling, there has also been an influx of same-sex divorces. The rules of divorce apply to anyone with a legal marriage.  As one half of a separating couple, you are subject to equitable distribution, and you may have rights to custody and support that require protection. Agreements & Negotiations

Getting married is an exciting occasion, but the reality is that a large portion of marriages end in divorce. If you are considering marriage, you should take appropriate precautions to protect your assets in the event you and your partner eventually separate. We will then prepare a draft agreement for you, or review the terms of any agreement prepared by the other party's attorneys.
